Tabu to Delhi HC, files suit against misuse of personality rights; pleads for protection from AI generated fake content

New Delhi: The Delhi High Court is hearing the suit of Bollywood actress Tabu regarding the misuse of her personality and likeness; including her image and name. The actress has approached the court for protecting her publicity rights and personality rights and specifically concerned that such material would be created using artificial intelligence (AI) technologies causing her significant harm and disparagement.

In her petition to the court Tabu claimed, some or the all of the personality-rights (including Name, Image, likings, attributes and personality) of your Petitioner are being used in an unauthorized, malafide and false manner… The Petitioner further prays that necessary directions be passed by this Hon'ble Court restraining creation of such AI generated matter which could damage the petitioner’s image and the reputation.

Matter heard by Delhi High Court

The case was taken up for hearing by the Delhi High Court Bench comprising Justice Jyoti Singh. While hearing the case, the Court requested that some deficiencies noted in relation to the documents in the petition be removed and fixed. The case has now been listed for the next hearing.

Many celebrities have already filed suits to prevent misuse of likenesses

Several prominent personalities and actors have in the past also sought legal help for the misuse of their names, likenesses and images on such digital and AI platforms from the Delhi High court which has granted them various protection orders against their image being misused.

Personality rights, simply put, give individuals control over the use of their image and identity for commercial or public purposes. Public figures are most affected by the misuse of their images as they have to rely on personality rights to prevent such actions.
